Where a client gives us access to personal data in its website, advertising, analytics or other systems and asks us to process it on the client’s instructions, the client is normally the data controller and New Era Digital acts as a data processor. This work is governed by the relevant service agreement or data processing agreement.
1. Personal data we collect
Depending on how you interact with us, we may collect:
- Contact details, including your name, business name, email address, phone number and postal address.
- Enquiry and booking information, including your service interests, business goals, meeting details and messages.
- Client and project information, including proposals, contracts, billing information, correspondence, website content, campaign data, analytics and account permissions you provide.
- Website and device information, including your IP address, browser, device, approximate location, referring page, pages viewed, cookie choices and similar technical information.
- Advertising and analytics information, including campaign interactions, conversions, attribution and performance data.
- Business information from public sources, such as company websites, search engines, directories and public business profiles.
Please do not send special-category personal data, passwords, payment-card details or unnecessary confidential information unless we have specifically agreed that it is required.
2. How and why we use personal data
We collect information directly from you, automatically through consented website technologies, from service providers such as Google and TidyCal, from clients and from relevant public business sources.
We use personal data to:
- Respond to enquiries, arrange consultations and prepare proposals.
- Provide and manage SEO, Google Ads, website and related services.
- Communicate with clients and report on work and results.
- Manage contracts, invoices, accounting and legal obligations.
- Operate, secure and improve our website and services.
- Measure website and advertising performance where you have consented.
- Prevent misuse and establish, exercise or defend legal claims.
- Send marketing where we have the required consent or another lawful basis.
Our lawful bases are taking steps before entering a contract, performing a contract, complying with legal obligations, consent and our legitimate interests in running, protecting and improving our business. Where we rely on legitimate interests, we balance those interests against your rights and reasonable expectations.
3. Cookies, Google tools and advertising
Our website uses essential technologies for security, functionality and recording your cookie choices. With your consent, it may also use Google Analytics, Google Tag Manager and Google Ads conversion tracking to understand website use, measure enquiries and improve campaigns. We may use Google Search Console to understand the website’s performance in Google Search.
Non-essential analytics and advertising technologies should only operate after the required consent has been given. You can change or withdraw your choices through the website’s cookie settings. Our Cookie Policy will provide more detail about individual cookies, their purposes and durations.
4. Consultation bookings
If you book a consultation through TidyCal, operated by Sumo Group Inc., it may process your name, email address, selected time, timezone and the answers you provide. It may connect with calendar and video-meeting services to create the appointment.
We use booking information to arrange and manage the consultation and communicate with you about it. Please do not include unnecessary sensitive or confidential information in booking fields.
5. Use of AI-assisted tools
We may use artificial intelligence and machine-learning tools to support research, analysis, drafting, editing, reporting, quality checks and service delivery.
Depending on the project, limited client or campaign information may be processed through a third-party AI provider. This can include business information, website content, campaign metrics, search data, project instructions and, where genuinely necessary, limited personal data contained in client materials.
We aim to minimise the information used, avoid special-category or unnecessary confidential data, use suitable business or contractual settings and review outputs before relying on or sharing them. Recommendations, content and client decisions remain subject to human judgement.
We do not use AI to make decisions about individuals based solely on automated processing where those decisions would have legal or similarly significant effects. Where we use an AI tool solely on a client’s instructions, the relevant client agreement or data processing agreement also applies.
6. Sharing information and international transfers
We do not sell personal data. We may share it where reasonably necessary with:
- Website, hosting, security, email, cloud and communications providers.
- TidyCal and connected calendar or video-meeting providers.
- Google and related entities for analytics, advertising and business services.
- AI, analysis and workflow providers supporting our work.
- Payment, accounting, professional advisory and specialist service providers.
- Regulators, courts or authorities where required by law.
- A buyer or adviser involved in a genuine business reorganisation.
Providers processing personal data on our behalf must protect it and use it only for authorised purposes.
Some providers may process information outside Ireland or the European Economic Area. Where required, we rely on an adequacy decision, the European Commission’s Standard Contractual Clauses or another lawful transfer safeguard. You can contact us for more information about safeguards relevant to your data.
7. How long we keep information
We keep personal data only for as long as needed for the relevant purpose and to meet contractual, tax, accounting and legal requirements.
Generally:
- Enquiry and consultation records are kept for up to 24 months after our last meaningful interaction, unless you become a client or a longer period is reasonably required.
- Client contracts, invoices and relevant business records may be retained for six years or longer where legally required.
- Project and campaign information is kept for the client relationship and an appropriate period afterwards for support, record-keeping and potential claims.
- Analytics, advertising and cookie information is retained according to our settings, your consent choices and provider rules.
- AI prompts or outputs retained by us are kept only where needed as part of the relevant project or business record.
- Marketing information is kept until you unsubscribe or withdraw consent. We may keep a minimal record to ensure we respect that choice.
Information is securely deleted or anonymised when it is no longer required.
8. Security
We use reasonable technical and organisational measures to protect personal data. These may include access controls, multi-factor authentication, secure service providers, confidentiality requirements, software updates and limiting access to those who need it.
No online system is completely secure. If a personal data breach occurs, we will assess it and make any notifications required by law.
9. Your rights
Subject to the conditions in data-protection law, you may have the right to:
- Access your personal data.
- Correct inaccurate or incomplete information.
- Request deletion or restriction of processing.
- Object to processing based on legitimate interests or for direct marketing.
- Withdraw consent where processing relies on consent.
- Receive certain information in a portable format.
- Lodge a complaint with a supervisory authority.
- Not be subject to certain decisions based solely on automated processing.
To exercise a right, email info@neweradigital.ie. We may need to verify your identity. We normally respond within one month, subject to the allowances in data-protection law.
You can unsubscribe from marketing using the link in the message or by contacting us. Our website and services are intended for businesses and are not directed at children.
